These Terms of Use (the “Terms”) govern your access to and use of Write It On Her. By accessing or using the website, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1) About the Service

Write It On Her is a marketplace that facilitates the purchase of personalized, digital content (e.g., custom videos) from independent creators. Creators are independent contractors and are solely responsible for the content they produce and their compliance with applicable laws. WIOH, LLC does not create or publish content; we provide platform infrastructure to facilitate transactions, including secure payment processing, content delivery, and account management. We may update, suspend, or discontinue any part of the Service at any time.

2) Eligibility (18+)

The Service contains adult content and is intended only for adults 18 years or older (or the age of majority where you reside). By using the Service, you represent that you meet this requirement and that your use is not prohibited by applicable law. We may implement age and identity verification measures as required by law or to protect the Service, and you consent to such checks.

3) Accounts & Security

  • Some features may require an account. You agree to provide accurate information and keep it up to date.
  • You are responsible for maintaining the confidentiality of access to your account and for all activity that occurs under it.
  • We may disable or limit access to the Service for suspected fraud, abuse, or violations of these Terms.

4) Orders & Payments

  • By placing an order, you authorize us and our payment partners to charge the applicable amount, including taxes and fees.
  • Payments are processed by third-party providers (e.g., card processors, cryptocurrency processors). We do not store your full payment card details.
  • Prices, currencies, and availability are subject to change. Obvious errors may be corrected and orders canceled or refunded.
  • Cryptocurrency payments: where offered, blockchain transactions may be irreversible; network and exchange fees may apply; exchange rates fluctuate; and refunds, if granted, may be processed in cryptocurrency or fiat at our discretion.
  • Compliance screening: we may conduct anti-money laundering (AML), sanctions, fraud, and risk checks and may refuse or cancel an order to comply with law.

5) Delivery of Digital Content

Orders involve personalized, digital content. From the time payment is confirmed, the creator must produce and deliver the content within a maximum of forty‑eight (48) hours. Content is typically made available in your account and/or via a download or streaming link. We will notify you when your order is ready.

6) Refunds & Cancellations

Because orders are personalized digital goods, refunds are limited. Please review our Refund & Return Policy for details.

Non‑delivery within 48 hours: If content is not delivered within forty‑eight (48) hours from payment confirmation, you are eligible for a refund; contact us at legal@writeitonher.com with your order number to start the request.

7) Acceptable Use

  • Do not request or upload illegal content, including anything involving minors, non-consent, or exploitation.
  • Do not harass, threaten, or abuse others, or attempt to circumvent security or payment systems.
  • Do not publicly post, share, resell, or distribute purchased content; see the Licensing section below.
  • Creators must comply with all applicable laws, including 18 U.S.C. § 2257 and 28 C.F.R. Part 75 where applicable; verify ages and identities of performers, maintain required records, and provide them upon request. Content involving minors or non-consent is strictly prohibited.
  • You will not use the Service in violation of export control or sanctions laws; you represent that you are not located in an embargoed country and are not on any restricted lists.
  • We may remove or disable access to content, suspend or terminate accounts, and preserve or disclose information to comply with law or enforce these Terms.

8) Intellectual Property & License

All rights in and to the Service and content (including creator content) are owned by us, the creators, or our licensors. When you purchase content through the Service, you are granted a limited, personal, non-exclusive, non-transferable license to access and view the content for your own private, non-commercial use. You may not copy, redistribute, publicly perform, or create derivative works from the content unless we or the rights holder give you prior written permission.

9) Your Submissions

If you provide text, instructions, or other materials (“Submissions”), you represent that you have all necessary rights and that your Submissions do not infringe any third-party rights or violate any law. You grant us a non-exclusive, worldwide, royalty-free license to use, host, reproduce, and display your Submissions as necessary to provide, operate, improve, and promote the Service and fulfill your order.

10) Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11) Limitation of Liability

To the fullest extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from or relating to the Service will not exceed the greater of (a) the amounts you paid for the order giving rise to the claim, or (b) USD $100.

12) Governing Law; Venue

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws principles. You and WIOH, LLC consent to the exclusive jurisdiction and venue of the state and federal courts located in Sheridan County, Wyoming, except where prohibited by applicable law.

13) Changes to These Terms

We may update these Terms from time to time. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
